Estonian Competition Authority
On 24th of July 2015 European Commission Regulation (EU) 2015/1222 establishing a guideline on capacity allocation and congestion management (hereinafter – Regulation) (http://eur-lex.europa.eu/legal-content/EN/TXT/?uri=uriserv:OJ.L_.2015.197.01.0024.01.ENG) was adopted.
According to Regulation, companies interested in operation as a power exchange within the European Union are required to be designated as a nominated electricity market operator (hereinafter – NEMO).
In Estonia the Estonian Competition Authority is the responsible authority for the designation process. The Estonian Competition Authority has an obligation to designate at least one NEMO whithin four months from the time the Regulation enters into force.
Applications can be submitted as soon as the Regulation has entered into force, i. e. since 14th August 2015.
The Estonian Competition Authority must have received an application not later than 15th September, 2015 at 24:00 (CET) and not earlier than the date the Regulation enters into force if a company wishes to be designated from the start, i. e. 4 months after the Regulation has entered into force.
